Introduction

Welcome to FlagVault's feature flag management web application ("Application"). These Terms of Service ("Terms") govern your access to and use of our Application. Please read these Terms carefully before using our Application.

By accessing or using our Application, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our Application.

Definitions

• "You" refers to the individual or entity that accesses or uses our Application.
• "We," "Us," "Our" refers to FlagVault.
• "Application" refers to our feature flag management web application, including all content, features, and services offered.
• "Feature Flags" refers to the toggles or switches created within our Application that enable the activation or deactivation of features in your software applications.
• "Account" refers to your registered account within our Application.

Account Registration and Security

To use our Application, you must register for an account using Google Sign-In. You agree to:

1. Provide accurate, current, and complete information during the registration process.
2. Maintain and promptly update your account information.
3. Keep your account credentials confidential and not share them with any third party.
4. Immediately notify us of any unauthorized use of your account or any other breach of security.

You are responsible for all activities that occur under your account. We reserve the right to suspend or terminate your account if any information provided is inaccurate, false, or outdated.

License and Use Restrictions

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Application for your internal business purposes.

You agree not to:

1. Use the Application in any way that violates any applicable law or regulation.
2. Use the Application to transmit any material that is defamatory, offensive, or otherwise objectionable.
3. Attempt to gain unauthorized access to any portion of the Application or any system or network connected to the Application.
4. Reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any content from the Application, except as permitted by these Terms.
5. Use any automated means, including scraping, data mining, or extraction methods, to access or collect data from the Application.
6. Interfere with or disrupt the operation of the Application or servers or networks connected to the Application.
7. Reverse engineer, decompile, or disassemble the Application or attempt to derive its source code.

Intellectual Property Rights

The Application and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, and the design, selection, and arrangement thereof), are owned by us, our licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You retain all rights to your data, including any feature flags and configurations you create within the Application.

API Usage

Our Application provides an API for accessing feature flag states. When using our API, you agree to:

1. Use the API in accordance with any documentation or guidelines we provide.
2. Not exceed any rate limits or other usage restrictions we may impose.
3. Implement proper error handling in your applications that consume our API.
4. Not share your API keys or credentials with any third party.
5. Use the API only for the purpose of accessing feature flag states for your applications.

Payment Terms

If you subscribe to a paid plan:

1. You agree to pay all fees associated with your selected plan.
2. All payments are non-refundable unless required by law or as specifically stated in these Terms.
3. We may change our fees and payment structure at any time by providing notice through our Application or by email.
4. If your payment is not successfully processed, we may suspend or terminate your access to the Application.

Service Availability and Modifications

We strive to provide uninterrupted access to our Application, but we do not guarantee that the Application will be available at all times. We may experience hardware, software, or other problems resulting in interruptions, delays, or errors.

We reserve the right to:

1. Modify, suspend, or discontinue the Application or any part thereof at any time, with or without notice.
2. Change the content, features, and functionality of the Application at any time.
3. Impose limits on certain features or restrict access to parts or all of the Application without notice or liability.

Disclaimer of Warranties

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APPLICATION WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

Limitation of Liability

IN NO EVENT SHALL WE BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

1. YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APPLICATION;
2. ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APPLICATION;
3. ANY CONTENT OBTAINED FROM THE APPLICATION; AND
4. UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

Indemnification

You agree to defend, indemnify, and hold us harmless from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Application.

Third-Party Links and Services

The Application may contain links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to these Terms shall be instituted exclusively in the courts located in Bangalore, India.

Changes to These Terms

We may revise these Terms at any time by posting the updated Terms on our Application. Your continued use of the Application after the posting of revised Terms means that you accept and agree to the changes.

Termination

We may terminate or suspend your account and access to the Application immediately, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms.

Upon termination, your right to use the Application will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the Application and supersede all prior agreements and understandings, whether written or oral.
